Have heard back from the nice lady who is taking $OverseasNonExistentPropertyCo to court. Her solicitor advises "as my contract is with $OverseasNonExistentPropertyCo in the UK the proceedings should take place over here and that $OverseasNonExistentPropertyCo are responsible for returning the money themselves."

bwa ha ha.

Papers are being served (on her behalf, not mine) on Monday.

Oh good. Trying to sue in another jurisdiction is a complete pain (which is why European e-commerce legislation generally gives the customer the right to sue in his or her country). But if this is a contract made in England under English law then there is, to use the technical terminology, a whole can of whoop-ass to be unleashed.

Is the plan for this to be a test case or are you (and other victims) considering joining this action as and when it looks like it has a good prospect of success?

We are hoping this will be a test case: if / when it succeeds, a group action is intended.
Though since their website includes a map of their location I am very tempted to go and ask for my money back in person. Used notes pls kthx. The Isle of Wight is lovely in the spring...
